1. The Golden Hour and Immediate Actions

The "Golden Hour" is the critical first hour after an accident where medical attention can maximize survival chances. Under the Motor Vehicles (Amendment) Act, 2019, any person, known as a 'Good Samaritan', who rushes a victim to the hospital, cannot be legally harassed by the police or medical authorities. Your first priority must be seeking medical help and immediately informing the local police to file an First Information Report (FIR). An FIR is a mandatory legal document required for any subsequent insurance claim or legal proceeding.

2. Understanding Insurance Cover

In India, vehicle insurance is broadly categorized into two types:

Third-Party Liability Insurance: This is mandatory for every vehicle under the Motor Vehicles Act. It covers liability for injury or death of a third party (other people) or damage to their property (their vehicle) caused by your vehicle. It does not cover damage to your own vehicle.
Own Damage (OD) Cover / Comprehensive Insurance: This is optional but highly recommended. It covers loss or damage to your own vehicle due to accidents, theft, fire, natural disasters, etc. It often includes third-party liability cover as well.

3. Filing an Insurance Claim (Own Damage)

If your vehicle is damaged in an accident, you must:

Inform your insurer: Notify your insurance company immediately. Delay can lead to claim rejection.
Document everything: Take pictures of the damage, the accident scene, and the other vehicle involved, if any. Collect witness details.
Submit the required documents: This typically includes a filled claim form, a copy of the registered Sale Deed (if relevant to ownership), the registered Mother Deed (if relevant to ownership), and a copy of the Mother Deed for verification, a copy of the Mother Deed for legal chain (showing historical ownership if relevant), a copy of the mother deed (verifying the chain of title), a copy of the Mother Deed for verification (showing previous owners if relevant), a copy of the registered Sale Deed and Mother Deed, a copy of the Mother Deed (establishing historical title) for property-related aspects, a copy of the Mother Deed (showing ownership chain if property is related to the claim), a copy of the Mother Deed for verification (showing historical ownership if the vehicle is related to a property claim), and a copy of the registered Mother Deed (showing historical ownership if related to the claim).
Wait for the survey: The insurer will appoint a surveyor to assess the damage before authorizing repairs.

4. Seeking Compensation through MACT (Third-Party Liability)

If an accident results in injury, death, or property damage to a third party, the victim or their legal heirs must file a claim with the Motor Accident Claims Tribunal (MACT).

Jurisdiction: The claim can be filed in the MACT of the area where the accident occurred or where the victim resides.
Procedure: The tribunal will conduct a hearing, consider evidence from the FIR, medical reports, and insurance documents, and then award compensation based on factors like the victim’s age, income, and the severity of the loss. There is no upper limit on the compensation for injury or death.
